The digital age brings with it novel forms of data flow. As a result, individuals are constantly being monitored while consuming products, services and content. These abilities have given rise to a variety of concerns, which are most often framed using “privacy” and “data protection”-related paradigms. An important, oft-noted yet undertheorized concern is that these dynamics might facilitate the manipulation of subjects; a process in which firms strive to motivate and influence individuals to take specific steps and make particular decisions (...) in a manner considered to be socially unacceptable. That it is important and imperative to battle manipulation carries with it a strong intuitive appeal. Intuition, however, does not always indicate the existence of a sound justification or policy option. For that, a deeper analytic and academic discussion is called for. This Article begins by emphasizing the importance of addressing the manipulation-based argument, which derives from several crucial problems and flaws in the legal and policy setting currently striving to meet the challenges of the digital age. Next, the Article examines whether the manipulation-based concerns are sustainable, or are merely a visceral response to changing technologies which cannot be provided with substantial analytical backing. Here the Article details the reasons for striving to block manipulative conduct and, on the other hand, reasons why legal intervention should be, in the best case, limited. The Article concludes with some general implications of this discussion for the broader themes and future directions of privacy law, while trying to ascertain whether the rise of the manipulation-based discourse will lead to information privacy’s expansion or perhaps its demise. We are currently witnessing a sharp rise in the use of algorithmic decision-making tools. In these instances, a new wave of policy concerns is set forth. This article strives to map out these issues, separating the wheat from the chaff. It aims to provide policy makers and scholars with a comprehensive framework for approaching these thorny issues in their various capacities. To achieve this objective, this article focuses its attention on a general analytical framework, which will be applied to a (...) specific subset of the overall discussion. The analytical framework will reduce the discussion to two dimensions, every one of which addressing two central elements. These four factors call for a distinct discussion, which is at times absent in the existing literature. The two dimensions are the specific and novel problems the process assumedly generates and the specific attributes which exacerbate them. While the problems are articulated in a variety of ways, they most likely could be reduced to two broad categories: efficiency and fairness-based concerns. In the context of this discussion, such problems are usually linked to two salient attributes the algorithmic processes feature—its opaque and automated nature. (shrink)

En este artículo se establece un análisis histórico, axiológico y epistemológico de las condiciones de advenimiento de una filosofía médica abocada al estudio de la enfermedad. El examen de estas condiciones toma en cuenta los estudios clásicos y contemporáneos de la filosofía de la medicina, analizando sus distintas perspectivas y enunciados. La reflexión en torno de los supuestos y conceptos asociados a tal tipo de filosofía, localiza la enfermedad en sus distintas dimensiones: en el ámbito del acontecimiento biológico (disease), del (...) orden social (sickness), y de la experiencia vivida (illness). En este artículo se revisa el lugar que ocupa Eckhart en L’essence de la manifestation, a fin de establecer correspondencias y afini­dades entre el místico renano y la peculiar concepción que de la fenomenología sostiene Michel Henry. Se trata de analizar la es­trecha cercanía entre el alma humana y Dios postulada por Meister Eckhart y su vinculación con la conocida noción de Vida presente en el autor francés. Henry es proclive a fundar una filosofía primera asociada a la pura autoafección, (...) describiendo la Vida sea como pura inmanencia, sea como una ipseidad algo problemática. En general, el trabajo teórico de los representantes del “giro teológico de la fenomenología francesa” (Janicaud) cuestiona al sujeto clásico de la Modernidad, sin por eso traer a colación la causa de un Dios Revelado ni el que resulta de una teología natural. Este trabajo, en suma, no es el esfuerzo de pensar a un Dios confesional ni tiene un propósito evangélico. Lejos de ello, se trata de precisar el nexo entre Henry y Eckhart, puesto en escena por aquél, y si tal nexo es coherente con lo que Henry piensa acerca de un modo de manifestación que ya no implica distancia fenomenológica alguna: la manifestación del pathos de la Vida. Suppose we learn that we have a poor track record in forming beliefs rationally, or that a brilliant colleague thinks that we believe P irrationally. Does such input require us to revise those beliefs whose rationality is in question? When we gain information suggesting that our beliefs are irrational, we are in one of two general cases. In the first case we made no error, and our beliefs are rational. In that case the input to the contrary is misleading. In (...) the second case we indeed believe irrationally, and our original evidence already requires us to fix our mistake. In that case the input to that effect is normatively superfluous. Thus, we know that information suggesting that our beliefs are irrational is either misleading or superfluous. This, I submit, renders the input incapable of justifying belief revision, despite our not knowing which of the two kinds it is. (shrink)

Most theories and hypotheses in psychology are verbal in nature, yet their evaluation overwhelmingly relies on inferential statistical procedures. The validity of the move from qualitative to quantitative analysis depends on the verbal and statistical expressions of a hypothesis being closely aligned – that is, that the two must refer to roughly the same set of hypothetical observations. Here, I argue that many applications of statistical inference in psychology fail to meet this basic condition. Focusing on the most widely used (...) class of model in psychology – the linear mixed model – I explore the consequences of failing to statistically operationalize verbal hypotheses in a way that respects researchers' actual generalization intentions. I demonstrate that although the “random effect” formalism is used pervasively in psychology to model intersubject variability, few researchers accord the same treatment to other variables they clearly intend to generalize over. The under-specification of random effects imposes far stronger constraints on the generalizability of results than most researchers appreciate. Ignoring these constraints can dramatically inflate false-positive rates, and often leads researchers to draw sweeping verbal generalizations that lack a meaningful connection to the statistical quantities they are putatively based on. I argue that failure to take the alignment between verbal and statistical expressions seriously lies at the heart of many of psychology's ongoing problems, and conclude with a discussion of several potential avenues for improvement. Engels explained his admiration for Balzac by pointing to an apparent discrepancy between Balzac’s literature and his politics. Despite his sympathies for the French nobility, Balzac’s realism “compelled” him to portray this class in unflattering terms. In this article, I challenge Engels’s reading, arguing that Marx’s scattered remarks on Balzac take us in a different direction. Specifically, I argue that in his remark on Balzac’s The Peasants Marx pinpointed the author’s preoccupation with the spread of bourgeois ideology into the nobility. (...) Building on this remark, I analyze several of Balzac’s works showing that insofar as Balzac lambasted the nobles, his critique was primarily directed towards nobles who had adopted bourgeois ways. In this light, and against Engels’s observation, Balzac’s critique of the nobles appears to stem from his sympathy to aristocratic values rather than conflicting with them. In showing that affinities between Balzac, Marx and Engels did not depend on Balzac expressing anti-noble sentiment, I argue that the admiration the fathers of communism had for the monarchist’s prose exemplifies a partial, yet typical convergence between socialists and conservatives in their critique of modern bourgeois society. In recent decades education is increasingly perceived as an instrument for generating economic growth and enhancing production. Unexpectedly, however, many prominent economists, throughout history, have rejected this view of education. This article examines the grounds on which Tibor Scitovsky, who was one of the leading economists of twentieth century America, objected to the spread of production oriented education. The article begins by an historical overview of the relationship between economic and educational theory. It then explains why Scitovsky held the economic (...) growth achieved in the 20th necessitates an educational reform and presents the outline of this proposed educational reform. It is argued that by distinguishing between creative and defensive forms of consumption and by highlighting the inherent tension between comfort and pleasure, Scitovsky offers an innovative and challenging conception of the desired relationship between economics and education that can serve as an alternative to the one that prevails today and amend its many fallacies. The paper concludes by briefly exploring some of the educational implications that stem from Scitovsky’s thought. It is maintained that Scitovsky’s views provides an original defense for teaching the arts and humanities and a suggestive perspective on consumer education and teaching of high culture. (shrink)

The philosophy of measurement studies the conceptual, ontological, epistemic, and technological conditions that make measurement possible and reliable. A new wave of philosophical scholarship has emerged in the last decade that emphasizes the material and historical dimensions of measurement and the relationships between measurement and theoretical modeling. This essay surveys these developments and contrasts them with earlier work on the semantics of quantity terms and the representational character of measurement. Whenever the membranes of the egg in which the foetus emerges on its way to becoming a new-born are broken, imagine for a moment that something flies off, and that one can do it with an egg as easily as with a man, namely the hommelette, or the lamella. The lamella is something extra-flat, which moves like the amoeba. It is just a little more complicated. But it goes everywhere. And as it is something - I will tell you shortly (...) why - that is related to what the sexed being loses in sexuality, it is, like the amoeba in relation to sexed beings, immortal - because it survives any division, and scissiparous intervention. And it can turn around. Well! This is not very reassuring. But suppose it comes and envelopes your face while you are quietly asleep... I can't see how we would not join battle with a being capable of these properties. But it would not be a very convenient battle. This lamella, this organ, whose characteristic is not to exist, but which is nevertheless an organ - I can give you more details as to its zoological place - is the libido. It is the libido, qua pure life instinct, that is to say, immortal life, irrepressible life, life that has need of no organ, simplified, indestructible life. It is precisely what is subtracted from the living being by virtue of the fact that it is subject to the cycle of sexed reproduction. And it is of this that all the forms of the objet a that can be enumerated are the representatives, the equivalents. Every word has a weight here, in this deceivingly poetic description of the mythic creature called by Lacan "lamella". Lacan imagines lamella as a version of what Freud called "partial object": a weird organ which is magically autonomized, surviving without a body whose organ it should have been, like a hand that wonders around alone in early Surrealist films, or like the smile in Alice in Wonderland that persists alone, even when the Cheshire cat's body is no longer present: "'All right', said the Cat; and this time it vanished quite slowly, beginning with the end of the tail, and ending with the grin, which remained some time after the rest of it had gone. 'Well! I've often seen a cat without a grin', thought Alice; 'but a grin without a cat! It's the most curious thing I ever saw in my life!'" The lamella is an entity of pure surface, without the density of a substance, an infinitely plastic object that can not only incessantly change its form, but can even transpose itself from one to another medium: imagine a "something" that is first heard as a shrilling sound, and then pops up as a monstrously distorted body. A lamella is indivisible, indestructible, and immortal - more precisely, undead in the sense this term has in horror fiction: not the sublime spiritual immortality, but the obscene immortality of the "living dead" which, after every annihilation, re-composes themselves and clumsily goes on. As Lacan puts it in his terms, lamella does not exist, it insists: it is unreal, an entity of pure semblance, a multiplicity of appearances which seem to envelop a central void - its status is purely fantasmatic. This blind indestructible insistence of the libido is what Freud called "death drive," and one should bear in mind that "death drive" is, paradoxically, the Freudian name for its very opposite, for the way immortality appears within psychoanalysis: for an uncanny excess of life, for an "undead" urge which persist beyond the cycle of life and death, of generation and corruption. This is why Freud equates death drive with the so-called "compulsion-to-repeat," an uncanny urge to repeat painful past experiences which seems to outgrow the natural limitations of the organism affected by it and to insist even beyond the organism's death - again, like the living dead in a horror film who just go on. This excess inscribes itself into the human body in the guise of a wound which makes the subject "undead," depriving him of the capacity to die : when this wound is healed, the hero can die in peace. We examine whether the "evidence of evidence is evidence" principle is true. We distinguish several different versions of the principle and evaluate recent attacks on some of those versions. We argue that, whatever the merits of those attacks, they leave the more important rendition of the principle untouched. That version is, however, also subject to new kinds of counterexamples. We end by suggesting how to formulate a better version of the principle that takes into account those new counterexamples.

Curiosity and creativity are central pillars of human growth and invention. While they have been studied extensively in isolation, the relationship between them has not yet been established. We propose that curiosity and creativity both emanate from the same mechanism of novelty-seeking. We first present a synthesis showing that curiosity and creativity are affected similarly by a number of key cognitive faculties such as memory, cognitive control, attention, and reward. We then review empirical evidence from neuroscience research, indicating that the (...) same brain regions are involved in both curiosity and creativity, focusing on the interplay between three major brain networks: the default-mode network, the salience network, and the executive control network. After substantiating the link between curiosity and creativity, we propose a novelty-seeking model (NSM) that underlies them both and suggest that the manifestation of the NSM is governed by one's state of mind (SoM). Contrary to the claim that measurement standards are absolutely accurate by definition, I argue that unit definitions do not completely fix the referents of unit terms. Instead, idealized models play a crucial semantic role in coordinating the theoretical definition of a unit with its multiple concrete realizations. The accuracy of realizations is evaluated by comparing them to each other in light of their respective models. The epistemic credentials of this method are examined and illustrated through an analysis of the contemporary (...) standardization of time. This work develops an epistemology of measurement, that is, an account of the conditions under which measurement and standardization methods produce knowledge as well as the nature, scope, and limits of this knowledge. I focus on three questions: (i) how is it possible to tell whether an instrument measures the quantity it is intended to? (ii) what do claims to measurement accuracy amount to, and how might such claims be justified? (iii) when is disagreement among instruments a sign of error, (...) and when does it imply that instruments measure different quantities? Based on a series of case studies conducted in collaboration with the US National Institute of Standards and Technology (NIST), I argue for a model-based approach to the epistemology of physical measurement. To measure a physical quantity, I argue, is to estimate the value of a parameter in an idealized model of a physical process. Such estimation involves inference from the final state (‘indication’) of a process to the value range of a parameter (‘outcome’) in light of theoretical and statistical assumptions. Contrary to contemporary philosophical views, measurement outcomes cannot be obtained by mapping the structure of indications. Instead, measurement outcomes as well as claims to accuracy, error and quantity individuation can only be adjudicated relative to a choice of idealized modelling assumptions. (shrink)

As a slew of recent work in epistemology has brought out, there is a range of cases where there's a strong temptation to say that prudential and (especially) moral considerations affect what we ought to believe. There are two distinct models of how this can happen. On the first, “reasons pragmatist” model, the relevant prudential and moral considerations constitute distinctively practical reasons for (or against) belief. On the second, “pragmatic encroachment” model, the relevant prudential and moral considerations affect what one (...) is epistemically justified in believing. The pragmatic encroachment model appears to have several advantages over reasons pragmatism, and this has led many recent philosophers to endorse the former. However, in this paper we argue that a version of reasons pragmatism can be (at least largely) saved from these purported disadvantages once paired with an independently plausible permissivism about epistemically justified outright belief. This hybrid view—“permissivist pragmatism”—holds that when there is more than one epistemically permitted doxastic attitude, practical (including moral) considerations can determine which epistemically permitted doxastic attitude one all-things-considered ought to have. This view avoids both the problems faced by simple versions of reasons pragmatism, and those that distinctively attend pragmatic encroachment, while preserving the advantages of each view. (shrink)

Sometimes, learning about the origins of a belief can make it irrational to continue to hold that belief—a phenomenon we call ‘genealogical defeat’. According to explanationist accounts, genealogical defeat occurs when one learns that there is no appropriate explanatory connection between one’s belief and the truth. Flatfooted versions of explanationism have been widely and rightly rejected on the grounds that they would disallow beliefs about the future and other inductively-formed beliefs. After motivating the need for some explanationist account, we raise (...) some problems for recent versions of explanationism. Learning from their failures, we then produce and defend a more resilient explanationism. (shrink)

When discrepancies are discovered between the outcomes of different measurement procedures, two sorts of explanation are open to scientists. Either some of the outcomes are inaccurate or the procedures are not measuring the same quantity. I argue that, due to the possibility of systematic error, the choice between and is underdetermined in principle by any possible evidence. Consequently, foundationalist criteria of quantity individuation are either empty or circular. I propose a coherentist, model-based account of measurement that avoids the underdetermination problem, (...) and use this account to explain how scientists individuate quantities in practice. The Self-Intimation thesis has it that whatever justificatory status a proposition has, i.e., whether or not we are justified in believing it, we are justified in believing that it has that status. The Infallibility thesis has it that whatever justificatory status we are justified in believing that a proposition has, the proposition in fact has that status. Jointly, Self-Intimation and Infallibility imply that the justificatory status of a proposition closely aligns with the justification we have about that justificatory status. Self-Intimation (...) has two noteworthy implications. First, assuming that we never have sufficient justification for a proposition and for its negation, we can derive Infallibility from Self-Intimation. Interestingly, there seems to be no equivalently simple way to derive Self-Intimation from Infallibility. This asymmetry provides reason for thinking that bottom-level justification rather than top-level justification drives the explanation for why the levels of justification align. Second, Self-Intimation suggests a counterintuitive treatment of information concerning what justificatory status a proposition has. It follows from Self-Intimation that we always have justification for the truth about whether a proposition is justified for us, and therefore, that higher-order evidence could change what we should believe on this matter only by misleading us. This permits forming beliefs about whether a proposition is justified for us without regard to higher-order evidence, and thus reveals a reason for thinking that top-level justification is evidentially inert.
